Notary Requirements

Does a will have to be notarized?

Does a Revocable Living Trust have to be notarized?

Does the trust have to be registered in any fashion to be put into effect?

1. A Will does not have to be notarized, but it must be witnessed and attested to in a very specific statutorily proscribed manner.

2. A Trust does not have to be notarized, but it is wise to do so.

3. No, trusts are not registered to be put into effect. But, in most cases they need to be funded in order for them to do what you want them to do. And, some trusts require their own income tax returns.
