Legal Question in Wills and Trusts in Illinois

A Sons rights

My father in law recently passed away there is a step child and 2 sons from a previous marriage. The wife has severe Alzheimers. A few months ago he went to a lawyer and had a new will made leaving everything to his 2 sons -the lawyer dropped the ball, drew up new will but never had it signed now the only will found is from 25yrs ago which leaves everything in joint tenancy to the 2nd wife. What are the rights of the 2 sons. The sons have also been locked out of the house with locks changed.

Re: A Sons rights

You have a few options. The sons may be able to file for a portion of the estate even if they were not named in the will. The sons may also have a chance to sue the attorney for malpractice if it really is his fault.

Please feel free to give us a call to talk about the details.
