Legal Question in Workers Comp in Illinois

I have had an l-3,l-4 fusion do to an injury at work. I have had a functional capacity evaluation already that has been validated and has found me to be permanently restricted to light duty work only and my employer wont let me come back to work under these restrictions. All my medical bills have been paid but the w/c insurance still owes me for fourteen weeks of back pay. My lawyer says I have to wait till we settle to get my back pay which I dont think is fair since all the doctors and hospital has been paid their bills. Plus what lies ahead for as far as employment and will my benefits continue to be sent to me?

No one can comment here online, ACCURATELY, without knowing all the facts and circumstances of your claim.

You stated that you already have an attorney. Ask your attorney these questions you have.

If your attorney does not have time to go into detail with you over the phone, schedule a meeting with them.

Take them out to lunch and discuss your concerns with them if that is what it takes.

You have an attorney. All your questions should be answered by your attorney. Write your questions down and then make an appointment with him or her and ask all these question. Get explanation about why you are not getting paid while other have been paid. Whether you think is right or wrong is irrelevant--the law is the law and life is often unfair...

I hope this helps-
