Legal Question in Workers Comp in Illinois

Lawyer yes or no?

I injured my knee on the job and will need to have it scoped. Do i have to hire an attorney or can I pursue the case my my self. I just want my knee fixed. I don't want a settlement unless something goes real bad, but i do want a fair shake. I don't want to be someone who takes advantage of the system but i do not want to get screwed either

You can always handle a claim on your own, but as you point out, you want to make sure you get a fair "shake". There are many pitfalls during the process that can come upon someone without a lawyer. For example, you will have surgery and then would be entitled to receive payment while your off work recovering. Will you get paid what you should while your off? Will the insurance company provide you the apporpriate medial care - not influence your doctor or you to get back to work sooner than you should? Will they ultimately offer you a fair settlement?

These are only some of the questions and issues that can arrise. You should know that the insurance company will do everything they can to save money - not just on your settlement, but by not approving tests, medical visits, or other. This is their job. Due to the complexity of issues, you deserve to have an attorney working to ensure you receive all of the care and money you are entitled to. Do not feel bad for looking for a settlement. If you have a knee surgery, you will be left with some permanent damage and that is the reason you are entitled to a settlement. You will have to live with this knee injury the rest of your life.

You don't "need a lawyer", but you also don't need a doctor to take out your appendix. But of course it's a good idea.
