You are not yet a citizen of USA; as such there is no bar in adopting a child in India. Once you adopt the child, he becomes your child, and I do not see any problem in taking him back to USA. However, more details are required for a cogent reply.

You must be a US citizen in order to adopt a child from a foreign country.

- nationality of both prospective parents.

- legal status of both prospective parents.

- if the prospective parents already have children / adopted children (if yes, nationality of origin of the adopted children).
