Property matter

Dear Sir,

I had planned to see off my flat to one person for a consideration of Rs 4,70,000. About three mths ago took a token of RS 25,000 and gave him in writing about the same on a Rs 100 Stamp paper. Now I have a Customer who is ready to pay me about 575000 for the same flat and i want to sell it to him.

cai i do it by telling the previous person a simple no or will any legalities will be involved.

well sole discretion is yours and about the token amount you need to return back the amoung or else you may face legalities

Law do not prohibit you from selling flat to thrid person during currency of an agreement , however it will be subject to right for specific performance of the agreement by the previous buyer.Thus it is not advisable unless you have reasons to terminate previous agreement.your query do not disclose the period of agreement with previous buyer.
