Legal Question in Consumer Law in India

Consumer Rights - Mobile Network Provider Issue

I was experiencing No Network coverage, Call Drops and Voice breaking issues.

Have made complaints to Airtel Authorities in June'08, again in August'08 and once again in October'08. problem not resolved

And later(for November and December'08) I have stopped payments to Airtel and told them that will make payment only if they resolve my problem.

Airtel did not resolve my problem and started calling for the payments only. They were least concerned about the problem that I am facing for so long and they just want the payment. I had been paying for utterly bad service for 8 months.

List of chronological events

April 2008- Took Airtel Post Paid Mobile Connection.

June 2008- 1st Complaint

07/Aug/2008- 2nd Complaint

Expected Resolution Date(as given by Airtel): 11/Aug/2008

Note: Airtel closed this complaint without resolving the same.

03/Oct/2008 - 3rd Complaint

Expected Resolution Date(as given by Airtel): 08/Oct/2008

Problem is not resolved till the date of my disconnection on 28/Dec/2008.

Please advise me what should I do now? What are my Rights?

It is your right to get satisfactory service. You can flie a consumer complaint against them, asking for proper service and monetary compensation for harassment caused to you. The Consumer Forum is likely to order them to improve service and also to pay compensation.

Re: Consumer Rights - Mobile Network Provider Issue

You may file a complaint with the local Consumer Forum and claim damages for the "deficiency of service" rendered by the phone company. You may not be liable to make payment of any bills raised by them.
