Legal Question in Consumer Law in India

Dear Sir,

We have taken the membership 1 year of Magic holiday ( a travel agency like country inn) on 12th Dec�12.

We found the commitment of the sales person & actual product is quite different & due to this we are asking them to give our money back but they are not refunding.

Now they are showing us the main document where we signed, it already mentioned that money is not refundable.

In another document (where sign was not mine though they are claiming its mine) due to which our conflict raised about benefit of RCI affiliation .As told by the sales person that we can avail the affiliation from day one but when we applied for this they told we are not entitled for this benefit s as we have not paid 50% amount(75 thousand) of the membership of 25 years (generally they call it full life membership) which cost 1.5 lac. But our 1 yr membership cost is 29 thousand.

Now this all discussion happened verbally, & we believed the sales guy.

After repetitive follow up with them ,these people telling us that as we signed the document that�s why they will not return our money.

My request to you that can we raise this case to consumer court? What is the probability of winning the case?

Can we ask for any compensation because the purpose of taking membership failed & we were forced to avail hotel at our own cost ?

Is there is any option to hire a lawyer on the ground of sharing compensation which is mutually agreed basis?
