collections

if an authorised company employee enters into a premises of a defaulting customer and asks for the payment of outstanding installments can he be prosecuted under the provisons of law, if there are any citations to this effect kindly let us know

If an employee of a creditor enters premises of debtor and threatens or blackmails the debtor to pay its dues,he commits the offence of criminal intimidation as per Section 503 of the Indian Penal Code.

The authorised employ of the creditor company is liable for prosecution under Indian Penal code. He commits offences of criminal tresspass, criminal intimidation and opens himself for prosecution under various counts of charges. There are numerous judgments of our own Delhi High Court.The law on the issue is well settled.
