Legal Question in Credit and Debt Law in India

I have done some sub contract works and have to receive an amount from main contractor. While asking the amount he simply denying and ask me to claim the same through court. I understand that he purposefully saying like this for delaying payment to me. In this position let me know the ways to collect the pending amount from him by not delay through a legal way. I have complete evidences for did my subcontract works.

hi,

Send him a legal notice through a lawyer and then file a recovery suit in the court.

You will surly get your money.

Let us know if the contractor is a pvt ltd company, you will have other options too.

Hi

First step is to send legal notice through a lawyer, and thereafter, you can file a civil suit for recovery. Also, if it is company, then you can also go for dissolution proceedings before company court.

If the contract speaks of arbitration, then you will have to proceed with arbitration proceedings.

Hello,

Firstly issue the Legal Notice.

Further Proceedings depends upon the reply or non-reply of the Contractor.

Arbitration is best way for settlement, whereas, it is costly. Hence, it is only recommended when you have to recover substantial amount.

Otherwise, mediations shall be adopted.
