Legal Question in Criminal Law in India

498a(no 406) FIR filed 9 months back after expiry of limitation period of 3years. I have not been in india for 3 years.can police need to examine me before filing chargesheet?how long will it take to serve me summons in australia?

they might summon you before filing chargesheet, however it is not mandatory. There is a separate mechanism and your high commission will process and serve you the summon. There is no minimum time as such.
