Legal Question in Criminal Law in India

have a 420 section case one me which is going around from last 5 years m the victim but my opp party is not been to the court for any dates.As much we know after 3 call if you opp party is not present the case is withdrwn please help my lawyer is not helpfull m just speding money

there is no rule that if on 3 calls the opposite party does appear, the case is dismissed. is it a state case, i.e. f.i.r is lodged or a complaint case. i would like to know the full facts before i opine further. you may also send me the copy of f.i.r/complaint on my mail i.d.
