The note is like a "dying declaration"; the law presumes that last declaration of a person is truthful when the person is taking his life.

Yes, the person can be prosecuted and the note should have evidenciary value, depending of course upon other circumstances; the person will have opportunity to rebut this or any other evidence that may be put against him.

if it is established that its the person named in the suicide note, has abetted the suicide, only then the case is made out otherwise, mere allegation that due to such n such person, suicide is being committed, is of no consequence.
