Legal Question in Criminal Law in India

my earlier question was that if i make a fake fb/email account to collect some sort of evidence will be considered as a crime or not ? I got answer as yes it is actionable.

But if the account is created with the particulars of non existing person i.e not matching with any existing or dead person's particular . Still collected evidences will not be acceptable and it will be a crime ?
