Legal Question in Criminal Law in India

Final Report u/s 173 CRPC required by the Insurance Company

Dear Sir/Madam,

ICICI Lombard Insurance company is asking to produce the Final Report u/s 173 CRPC for my vehicle (Scooter) theft when I have already submitted Untrace Report which I received from the Police Station. Is it ethical from them to put such requirement as in my neighborhood there was car theft and the Insurance Company (Bajaj Alliance) settled the claim on the basis of Untrace Report. I am confused please guide me in the right direction.

Thanks in advance.

These are usual tactics of insurance companies to delay payment.

Consult your lawyer, issue a strong notice and then approach either consumer forum or court.

You may also consider taking up the matter with regulatory authorities in public interest to have a general guideline issued.

The "untrace report" and "final report u/s 173 Cr. P. C." is same thing.

You may seek necessary clarification from the police station and ask them to mention 'FR u/s 173 Cr. P. C." on the "untrace report" given to you.

Well!!! it is a procedural issue you need to consult the Insurance Company or refer the insurance document which would tell you when the claims are passed.
