if compliant is filed after three years then will we have any case law to avoide discharge if the accused persons

Please note that complaint in criminal cases do not follow any sort of limitation. Although delaying complaint may reduce its value which benefits accused person. Accused person is not discharged at once but benefit of delay goes to accused. Convince court on delay. As soon as you cover the delay on material grounds, court may take cognizance upon offence and trial may commence.
