Legal Question in Criminal Law in India

Dowry Prohibition Act - IT Return

I have been booked under 498A R/W 3&4 of DP Act in august 2008. Wife has mentioned in the complaint that dowry has been given at the time of marriage and also after the marriage. Charge sheet is not yet filed. I want to get the details of Income tax returns of my in-laws. I also want to the details about their Ration Card, as I now that they have a White card and in that they mentioned that their annual income is less than 20,000/-. I want to use this as a proof of their income. Please let me know how I can use RTI or police or court to get these details.

Please note dowry articles neither can be given nor demanded as per law of the land under Dowry Prohibition Act, 1961. Your defence is obvious. Why you worry?

Re: Dowry Prohibition Act - IT Return

These details may not be very helpful to you. It may not be necessary for the girl or her parents to prove their income or sources because 'istridhan' is the sum total of what the bridge gets in marriage from both the sides as also from all the relatives. Even if 'they' did not have sufficient income, they could still pay handsome 'dowry' with the help of their relatives and friends.

It would be better if you try to reach an out of court settlement and compromise the entire dispute in one go. This kind of litigation is very expensive, tiring and the results are uncertain. You may instead make efforts to avoid litigation and buy mental peace.

Ration card is not a proof of income.

You may try under RTI. Else, you can get summons issued from the court at appropriate stage.
