Legal Question in Criminal Law in India

Dowry Prohibition Act

I have been booked under 498A R/W 3&4 of DP Act in august 2008. Wife has mentioned in the complaint that dowry has been given at the time of marriage and also after the marriage. As per Section 3 of DP Act, a case should be registered against my wife and her parents. How I can get that case registered? Her parents have not given any statement as of now. Charge sheet is not yet filed. Can I ask the Circle inspector to book that case against my in-laws & wife?

Re: Dowry Prohibition Act

At this stage filing your complaint may harm you. You may defend your case on violation of case by your wife which you have stated as the Dowry is prohibited at law and punishable offence.

Re: Dowry Prohibition Act

Your complaint may not have any value in law. Better try to reach an out of court settlement and compromise the entire dispute.

You can book a case, but it is only a counter case. You can give the complaint to police/ court. Thnik twice, the very complaint may lead to your admission.
