the person who is abroad, has to hire a lawyer in india and need to apply for anticipatory bail.

Police will investigate the matter and if found person guilty then register an FIR against that person. Person has to hire an advocate to get Anticipatory bail and if offence is not maintenable as per that person then he can persue for quahing from High Court.
