Regarding sent ruling

Respected Sir,

I am an advocate of plaintiff. Under Section 138 of Indian Negotiable Instrument Act, in a Criminal Suit (court of Chief Judicial Magistrate, BARMER, Rajasthan ) accused has given a advance cheque for Rs.1,00000(one) lack to plaintiff. Accused said in his defense evidence that he did not know plaintiff and the cheque was not given to plaintiff, it was given to his father, who was an accountant at mining department, in connection with his (accused) dues in regard of an application for desire mining lease for khasara no.194 on dated 10.7.05 in mining department.

The statement given by the accused in evidence was false, to tell the fact�s to the Honorable Court plaintiff has submitted an application on dated 11-3-07 under section 311 of Criminal Procedure Code with a document of joint venture, in which plaintiff & accused has purchased a Mixture Machine and requested that seller of the Mixture Machine may kindly be called for evidence in the Honorable Court, so that it may be proved that the accused has been knowing the plaintiff.

After filing of the application under section 311 of Criminal Procedure Code, ......sorry for continuous matter....page2 continuous................
