I send notice under section 138 through speed post on dated 15.01.2011 till today 25.02.2011 (after 43 days) I do not receive acknowledgment, how can we file the complaint in the court without acknowledgment of the notice.
Shell we resend notice by registered post and UPC.
Please guide us.

even though you did not receive the acknowledgement but was sent at the right address, you should file the complaint as the period of limitation would be over with a few days. the notice must not be sent again.
