custody of kids
If the husband is found guilty of infidelity but still wants custody of the child in India based on his infidelity would they favor the mother to keep the kids? Also if he gets custody of kids can he leave the India or can the wife stop him. I will be divorcing my husband.

even though the husband is successful in getting the custody of kids, still he cannot take the kids out of india and you can seek stay from court. whenever the custody is granted to one spouse, it is not an absolute custody and there are conditions attached to it.

The court may decide custody matter after taking all factors into consideration and in the best interest of the children.

Custody of kids shall be based on some preconditions and just either of the two cannot do anything he/she likes.
