Legal Question in Family Law in India

My husband beating me more and also police warned him eventhough
he not stopped. After giving strong warning he is not comming to home. Present i am alone we our own house but he is with their parents 40 km. away and he is forcing me to come but i have doubt they may kill by beating with his parents support hence i am not going till date i have not booked case. Is there right to me to ask maintenance for me and for my 1 year son thru legal. I am not ready to give divorce.

You may

a) register a criminal case u/s 498-A IPC

b) make a complaint under D.V.A.

c) seek maintenance under H.A.M.A. and also under DVA.

You may continue living in the house and call the police whenever you face any threat of physical abuse.
