Legal Question in Family Law in India

salary

1. Due to false 498A, the in law was suspeded from his job as he spent in jail for 4 days.

2. Charge sheet is yet to be put

3.Can he get half salary or no salary? whats the state now?

4.Even after charge sheet was put can we appeal in high court for quash.

please tell me what are the benifts he loose in his job?.

Unless the charge sheet is filed, there is no point going for quashing. You may go for quashing before high court, if you find good cogent grounds. the salary and loss of benefit would depend upon the conduct rules of the employer.

The suspended person will get half salary and after one year ( or as per service rules)will get two-third salary upto the order of the case in which the person was suspended from the job.

You may move to the concerned High Court for quashing sec.498-A.

You will not get any benefit if he loose the job. You will be in trouble when you will seek maintenance/life support from jobless person. For further query contect me.

During supension period employee is entitled to 50% of salary and other regular benefits.You can go for quashing of FIR and can also file revision if you are of the opinion charges are not made out.For any other query/assistance you may cal on my mobile.

he will get salary as per rules and regulations of his office. should get half of it at present

quashing proceedings can be initiated.

he can get suspension allowance, depending upon his service rules. he can also be reinstated since he is out of jail now.
