Legal Question in Civil Litigation in India

Bathroom of family staying above me is leaking. They do not bother to repair it. I even offered to pay full cost of reapairs but they do not respond. My cooperative housing society office also wrote him two letters but he ignored them too.

Due to leakage slab is fully drenched and leakages is seeping into walls also. We are afraid that a part of it may fall over our head or cause short circuit as power lines to geyser and AC are running close by.

I want to know if I have any legal remedy. If yes, how should I go about it.

Dear Sir,

This can be a tortuous activity, then you can lodge suit for private nuisance & general negligence in the Civil Court & ask for the respective damages, or you may also look in for any remedy under Indian Easement Act of 1882.
