i cheque of a/c payee of Rs 10.00 lac got misplaced by me .and a month later i have also intimated to near police station and did stop payment.now someone known to me has falsely put that cheque for clearing and it returned on behalf of stop payment has send a legal notice saying that he has given me a friendly loan and there is no other agreement between us in writing.And he has also filed the case u/s 138 .Am i legally bound to pay the money . some of our common friend told me that he is thinking of charging me u/s420.what remedies i have please tell and same is the story of Rs 8.00 lac that is also drawn by other friend and both these are friends also.

Well you must reply to the legal notice sent by him to you.

You are safe because you have already filed a report before the police and also stopped the payment.

Dont worry , even if he files a case under Section 138 NI Act read with 420, the same is liable to be dismissed.

your story does not hold water. how can your signed cheque be stolen that also by a person known to you. think of some better defence or compromise the matter.
