Legal Question in Civil Litigation in India

Our Society is registered society. Our treasurer has resigned in October�2008 but it was neither disclosed in the general body meeting nor elected new treasurer.

Only our secretary knows that fact. We have three signatory in bank for operating bank account. In bank transaction President or Secretary and treasurer�s signature is compulsory. After resignation of our treasurer in October�2008, he and secretary continued bank transaction till May�2009. Secretary has also resigned after six month and new secretary was elected. At the time of election of new secretary, out going secretary was not mentioned the matter of resignation of treasurer.

My questions are

1. Can treasurer operate bank account after his resignation?

2. The matter of treasurer resignation was not disclosed by them. Is this an illegal procedure?

3. Appoint of new treasure was not done? Is this an illegal procedure?

If your treasurer resigned, there must be some document. If he and other office bearers continued with him, it shows his resignation was not accepted.

It depends on a study of your Memorandum and Articles/ Bye - Laws of your society to know the exact crime if any committed.
