Legal Question in Immigration Law in India

b1/b2 pending

Hello sir,

I applied for B1 visa from India and was said by the counsulate that they are keeping my visa on pending. Actually they are ready to issue me H1 or L visa instead of B1. And under section 221(g)they have kept my visa pending.

But my company sends their employees on B1 only.

So first I have to go and remove the Section 221(g) and my question is that since my visa was not rejected and was kept on pending can I get B1 visa on the same application after removing section 221(g) or I need to reapply? Please help out.

Re: b1/b2 pending

Dear Applicant:

You will have to reapply for a B1 visa and remove the discrepencies under 221 (g). It will be on the discretion of the consular whether to issue you a visa or reject it.
