'' validity of visa when applied for extension ''

An american citizen employed as a consultent in India. He Came to India on a Business Visa expired on 10th Sep 2004 and applied for extension on 31st Aug'04.he started his work on 1st Oct'04. he is working in a company at present. the question is whether the visa is valid when applied for extension.what is the position of validity of visa.when the applied for extension for visa can he work in India.is it legal to stay in india and work.

Any one on a business visa is not allowed to work in India. As far as extension goes as it was filed within the validity of his visa. Thus if the extension is granted he is legal in India. To be allowed to work he has to apply for work permission with the home department. This can be done with a proper Job Offer and other formalities.
