Legal Question in Intellectual Property in India

I brought a house in Thane year 1991, in joint account with my mother name as a respect to my mother, after 20 years my mom who is more than 80 plus, ask her for the house document, for my surprise what i notice the original document is signed by my mother and my brother, after handing over the document to me, my mother send a legal notice to me saying that i took the house document, in the absent of my younger brother, as everyone knows that i have paid total amount, for my surprise after few days my brother produces a legal document saying that after her death he will get hundred percent of her share to him, my mom is not educated, as i dont stay with her, i m an NRi he made a will sign on his name even on my anchester property,illegally he made a voting card of mine without my notice, he say's go to the court if you want, what can i do

You are 50% owner of this house as the property is joint name ie. your and your mothers name. What your brother had through your mother is condemnable and you have lot of criminal and civil remedies available under the indian laws. this is a case of cheating and forgery and he cannot forge documents in your absence. you being an NRI, may initiate civil as well as criminal action in this regard. you may read more on property and criminal laws on my website www.karvai.in
