Suspension of an Employee

A bank employee in Gujarat is suspended pending inquiry in June 2006.

The inquiry proceedings were completed in March 2007.

The employer is not proceeding furtther for proposed punishment.

The enquiry is delayed by management.

At What subsistance allowance is payable to the emolyee ?

Whether he is eligible to claim the suspension period as the period spent on duty.

the employee can claim the wages of the usspenede period only if the inquiry is in his favour. Otherwise, he can file an appeal agasint the order of bank, and pray for reinstatement with full back wages.
