Legal Question in Employment Law in India

VRS Application

Want to know/understand 2 decisions of Supreme Court. They are-

In VRS [Voluntary Retirement] if applicant asks for release for a particular date and then if he is not released by that date then does the application stands rejected/ cancelled or otherwise?

Also, for what duration, the application for VRS remains valid? Is it valid only for 6 months or more?

Re: VRS Application

1. The applicant must give 3 month's notice in advance for VRS duly indicating a date on which his VRS has to be accepted and he relieved from the duties.

2. The authority competent must inform his decision either to accept or reject the VRS request made.

3. If no acceptance or rejection is received within that particular date, the employee can proceed on VRS at his own will. The emplorer is liable to pay all the retirement benefits to him in the event of such a happening even though a formal order accepting his VRS is not issued by the employer till the date of his relief.
