Legal Question in Landlord & Tenant Law in India
I want to break my apartment lease due to death of leaser. Myself, Father, mother and brother were living in house which was took for lease (Rs 4.5lacs) for three year from the date Sept 2010 from my father in Tumkur - who expired on May 24 2011. As Myself and my brother are working in Banglore - we dont want to leave our mother alone in Tumkur. So we want to break the Lease ASAP and move to Banglore along with our mother. But House owner says they have took loan from bank to build that house so they have to pay EMI - they cannot arrange the amount now. So they ar asking to us find some one else who can occupy the house. We have hired Brokers and tried to find tenants - but was unsucessful as the house is far from city. Please advice in this regard to break the lease as our father has signed the agreement for 3yrs.
