rights of my property after it has been leased out

iam a 75 years old widow in pune and wish to lease out my shop jointly owned with my son .i have some doubts 1) is it safe to lease my shop to a tenant ,after registering the document 2)what are my rights ,if the tenant refuses to evacuate after the term expires

If you execute a lease deed , then it is very safe, as it will be merely a contractual right and not staututory, in that after the period of lease is over, the lessee is bound to evict the premises.

Now in case of normal tenancy , it is required to be seen as to what law is applicable in your state.

In gujarat state a tenant is not entitled to tenancy protection till 10 years of fresh tenancy.

I advise you to execute a lease deed on proper stamp papers and get the deed regsitered

There is no harm to let out the property through registered lease deed and in such circumstance your right shall remain intact and if tenant refuse to vacate the propery then you can approach the court and you will easily get your property vacated but you shall also be entitled to damages from the tenant.Consult a local lawyer.

there is always a threat of tenant not leaving the property and therefore there are laws but laws take time.... so be ready for delay but you can get justice in case of any problem.
