Legal Question in Real Estate Law in India

Partition of a house between 2 bros in two equal halves; One wants horizontal, floorwise while the other wants vertical as he too wants the share of ground floor in view of more utility & commercial value and also the fact that land being immovable is more valuable as against the movable building. If no amicable solution what does the law favour horizontal/ vertical?
