Who should repay the disburse amount in case of cacellation of flat booking.
I booked a flat in banglore june last
year under pre emi scheme. I have
taken loan from HDFC and HDFC
disbursed first installment of 20%
of complete loan amount and I paid
10% of loan amount. As per
scheme builder has to pay pre emi.
But since last 3 month builder
hasn't paid pre emi and since last 6
months construction is stopped.
Now I want to cancel my booking. I
have question regarding loan
repayment.
Who should be responsible to pay
back the loan amount taken from
bank.

only you are responsible but you can file a case of specific performance agians the builder and he has to deposit the amount.

Borrower and Guarantors, jointly and severally.

The borrower may be responsible to repay the loan; however, you may lodge a claim against the builder and claim damages.
