Legal Question in Social Security Law in India

Respected Sir/Madam,

I am a male media marketing professional and a MBA by qualification. I am in love affairs with someone and she also loves me a lot and we cannot live without each other. We both are majors and of sound mind and belongs to the Hindu community.

My girl friend's parents are business minded and is not accepting our relation. Financially both of our families are equal or may be little more or less. Her family is quite richer than my family.

My family is a service class family and respected in the society and everyone in my family is in government job. But her parents are looking for a business class family

I have tried my level best to convince them and even my family wants to talk to them but they refused to talk to my family.

Now they are forcing her to get married of their choice. But she is not interested to get married with any guy except me.

Now they are beating her in order to levy their decision on her.

I am very depressed and worried about what to do in this regard.

My Questions from you guys are:

Ques: - What should I do in this regard when both of us cannot leave each other at any cost?

Ques: - What are the Pros and Cons of court marriage?

Ques: After court marriage if her parents blackmailed her emotionally and in emotional pressure if a girl back out / back step then what will be the consequences on me? And what are the precautionary steps I need to take before going for court marriage?

Ques: If I go for Arya Samaj marriage then what precautionary step I must will have to take in case girl back out for any reason either emotionally or other by her parents and I will not be a victim?

Ques: Please suggest me the precautionary steps for either Court Marriage or Arya Samaj Mandir Marriage? And which is more suitable for me in terms for safety and less time consuming and protect me from any illegal liability in case a girl back outs after marriage?

I find it that there is no other option except Court marriage or Arya Samaj Mandir Marriage.

Please guide me and go through the situation carefully as I am relying completely on you.

When both boy and girl are major, they are free to marry as per their own free will and wish, their parents cannot abstain them, or restrict their movement. You have legal way out. Recently supreme court has also acknowledged that when both boy and girl are major, they cannot be restrained from marriying as per their choice, and police protection should be given to them in case of any haressment or hurdels from their family.

You should go for court marriage, it is safest way for you in terms of law and in case of her backing out in future.

Feel free to conact in case of any difficulty or advice.
