Debit Collection

I gave a $400 loan to my ex-fiance. He agreeed in writing to pay it. Now I am getting ready to file small claims in two days to make him pay. He says that he is filing bankruptcy in two weeks and will include the loan from me in it so that he does not have to pay. Can I stop him? If I file first will that matter? Or should I just write it off as a learning expereince?

Four hundred dollars is a very cheap tuition concerning loans to boyfriends. Since you have something in writing, you might see about assigning the debt to a collection agency. That way the miserable creature will still have to respond to someone, but not you, for his obligation. It will be discharged in bankruptcy, if he ever really files.
