when one parent takes the other back to court to modify visitation from supervised to regular visitation according to the guidelines can the mother ask the judge to speak with the children ages 9 and 6? Also the children say they dont want to spend the night with the father because that would ruin their summer and make it so they wouldn't be able to spend much time with their mom and step dad. They didn't say that they didn't want to spend time with their father.

Sure, the mother can ask the judge to speak to them. Chances are that the judge will decline. Be aware that Indiana law frowns on children dictating when parenting time shall take place. In fact, you as the custodial parent are responsible for encouraging the children to see their father on a regular basis pursuant to the guidelines.
