A Petition must be filed in a court of proper jurisdiction. If you are the custodial parent, then you will file the petition. Sometimes, if the state has taken a child, it may turn out that they will seek to terminate the parental rights.

This is not something that you're going to be able to do without a lawyer getting involved. These can be very tricky, and in some cases, simply not doable. The lawyer can tell you after a consultation whether or not you might prevail in such an action.

Indiana law only provides certain ways to terminate parental rights. From what you provided, no one can tell you if the rights can be terminated or if they cannot.
