Legal Question in Family Law in Indiana

sanctions against attorney

going to file a complaint with the commission against an attorney for unethical behavior involving misuse of evidence. my question is if i wish for this evidence to be thrown out and if i further wish this attorney to be dismissed from this case should i also file this complaint with the local court? (the attorney in question is the opposing attorney) thank you

Re: sanctions against attorney

You can only file complaints against your own attorney.

You can't ask for discipline against the other side's attorney. Your complaint would be dismissed immediately.

I assume that you can see the rationale behind that -- everyone hates the other side's attorney.

It's YOUR attorney's job to deal with misused evidence, and there are legal mechanisms to deal with that.

Hope this information is helpful to you. Best of luck in your case!
