Legal Question in Civil Litigation in Indiana

under age cell phone contract

I let my cousins son (he is 17 years old, but turnes 18 on 12/23/2006) use one of my cell phone lines with the understanding that he would pay for the bill for that line. We had him sign a paper stating this. His mom would not sign it though. She told me that she would make sure that we would not get STUCK with the bill. Well he has had the phone now for 2 full months and he has not made any effort to pay his bill he downloaded over $120 in ring tones and wont pay for it last month his bill was $236. This month his bill is $109 and still no payment. All of our phones have been shut off and are in threat of a disconnection fee of $250 per phone (we have 5 cell phone lines) because I do not have the money to pay over $340 of his bill. What can I do about it?

File a small claims case against the mother and cancel that phone line.
