Legal Question in Civil Litigation in Indiana

Appeal to Superior Ct.

I was sued in Small Claims court. The judge ruled in my favor. The plaintiff appealed to Superior Ct. and has demanded a jury trial. I do not want a jury trial. Someone has told me that the plaintiff cannot demand that it be a jury trial because he he had a Small claims trial. Is this correct? This is Marion County.

If you go to the INdiana Judiciary web site, you will fine the rules for small claims and a small claims manual that you can download and should have the answer for you. You can also download the local rules for Marion County. Good luck
