Legal Question in Civil Litigation in Indiana

Can I sue a company for undue Stress

I worked for a Cable system that was being sold. I was given a bonus to stay till it sold so I could answer any technical questions and was made aware of its progress throughout. We started negotiations about a year and a half ago. It became more serious with a new company early last year. I started being pressued early on to get things done for the new company. I became physically ill in March 2002 and my doctor did all kinds of tests. All were negative, my last visit they checked my blood pressure then ask me if any thing was bothering me. I started talking about my job and blood pressure went up. The doctor informed me that I had work related stress and put me on xanax. The new company offered me a job in october for less money and gave me 12 hours to decide, even though they didn't even have financing secured. I had to decline. I signed up for unemployment and they fought me, but the local office agreed on my behalf on jan.30. I just found out yesterday that they requested a hearing. Here come the stress back. Is there any legal recourse for this situation.

Re: Can I sue a company for undue Stress

Stress-related injuries are difficult to establish under regular legal remedies. If your doctors will testify that your employment condition caused the stress, you might be able to make a workers compensation claim against the employer. This is unusual, so consult a workers comp specialist in your local area. You want to make sure you are not jeopardizing your unemployment benefits. There is absolutely no stress remedy against the employer at this stage of the unemployment compensation case, since they have a right to contest the award. Good luck.
