Legal Question in Civil Litigation in Indiana

being sued for lot rent

last year i left my husband and moved in with my girlfriend. Also, my handicapped son and three grandchildren i have custody of. After a month I moved back with my husband. My friend is taking me to small claims court for back lot rent of 8256.00 . My name is not on any documents or leases. This law suit is also for 24 months of lot rent. I moved in with her on 2/9/08 and moved out on 3/7/08. She did buy this double wide especially for all of us and I do feel horrible about leaving her with it. After I moved out she locked me out so I couldn't get in to get the rest of my stuff, including medicine for my handicapped son and clothes for the kids. Am i responsible to pay for this lot rent. The actual suit is for $6,000. I have no job and it isn't my husbands fault or responsibility. Thank you

Re: being sued for lot rent

Based on the facts presented, you may be responsible for all or part of the claimed damages. I do not think that you are going to be off the hook entirely. Your best argument is to state that you are responsible for 1/2 the rental amount up until the time that she locked you out of the property. Thereafter, since you did not have access becasue she locked you out, you should not have to pay. This is your best argument. You also have a counterclaim available for the value of the clothes and medicine. Again this posting is based solely on the information provided. Good luck
