Legal Question in Employment Law in Indiana

age discrimination - new hires

I was over client services for approx 2 years. Was told to hire young. I'm not a boss any more but continue to work for the same company. Can I file a complaint 2 years later? I don't have anything in writing.

Re: age discrimination - new hires

Being told to hire young does not give you an individual claim -- unless you are no longer a boss because you refused to do as you were told. However, any such claim may be untimely. There is a 180-day statute of limitations that applies to age discimination claims brought in Indiana (versus 300-days for other discrimination claims). When were you demoted? Also, if one of the applicants you rejected because of age brings a timely claim --and you act as a witness -- you are protected from retaliation.
