Discrimination case or not?

I was approached by an employee and former UAW rep. about the President of our local calling me an Asian c**t. He said that he himself witnessed this and that others within his group witnessed it. This person who gave this information had just retired.

I have been having ongoing harrassment issues with the UAW Pres. and issues due to retaliation against me for challenging him about being discriminatory before. I took the information and gave it to the HR people. The person who gave the info to me said he was willing to come back to work anytime and sign a statement to the facts.

The HR dept. later told me they couldn't do anything because the person who gave the info was retired and they don't bring those people back in for statements at that point.

Is there anything I can do? The issues before I didn't have a witness and the HR dept. told me unless I had witnesses there was nothing I could do. Now I do have one and they say they can't use this person, even though he specified he would come back and make a statement.

From your description, it sounds as though you are being subjected to a hostile work environment based on your national origin/race as well as retaliation, if the treatment stems from animus generated from prior complaints of discrimination on your part.
