Legal Question in Employment Law in Indiana

Withholding last paycheck

in indiana, i quit my job 1 month ago at a grocery store. they are withholding my last 2 paychecks and saying i stole something over 6 months ago that i have to pay for before i can get my checks, even though they did not mention anything about it between then and now. if they have no proof of theft, are they legally able to hold my checks? Are they required to take action against theft within a certain period of time after they suspect it happened?

Re: Withholding last paycheck

They are not allowed to withhold your paychecks -- period. If the total gross amount of the checks is under $800, you should contact the Indiana Dept. of Labor at 317-232-2655. If it is $800 or more, please feel free to contact me at the below phone number.
