Legal Question in Personal Injury in Indiana

A local .com news paper company in Michigan published an article concerning my protective service case involving my children. They wrote about my daughter (16 at the time of the article) being sexually abused. I have no doubt that this writing was inspired because of the fight I gave their local government to retrieve my children from foster care. No formal charges were ever brought against me and the children were removed on �preventive service� pretenses. I never heard of this news company printing anyone else�s protective service family court case. I wrote a letter to the company asking them to take the article out of their public achieve or to publish my response to their article. The company has done neither. I thought these types of cases were private from the public because they involve personal information about minors. Could my children or I bring a law suit against this company?

Based on the facts provided, I cannot tell you whether there is a vaild cause of action in Indiana or not. However, probably not a good idea to pursue if your concern is your family's privacy. Also, by requesting an opportunity to publish a response, an argument could be made that privacy really was not an issue with you, rather the perceived injustice that you have about the foster system. You may also need to post this for a Michigan attorney rather than Indiana.
