Legal Question in Real Estate Law in Indiana

Debris from tree falls on neighbors property

We have a large willow tree in our front yard, and the branches hang over onto my neighbor's property. In spite of the fact that we pick up debris from the tree (small branches and twigs) at least once a week, our neighbor seems to be upset. He frequently picks up anything that has fallen into his yard and tosses it haphazardly back onto our property. Are we responsible for the debris that falls in his yard? We've been cleaning it up to be kind, but he still tosses anything he finds back into our yard.

Re: Debris from tree falls on neighbors property

Although other factors might change this answer, the law in Indiana is that you are generally responsible for branches that fall into another person's yard from a tree in your yard.

Unfortunately for you, you are responsible for branches that fall in his yard that overhang the property line.
